Wisconsin Court: Search Marketers Can Use Rival Names Online

Companies use a wide range of web marketing tactics to reach their prospective and current customers online. In fact, approximately 26% of B2C’s and 20% of B2B’s develop pay-per-click campaigns to generate leads online. 

This practice requires marketers to bid for ad placement in popular search engine result pages, most often generated by keyword research.

A news article by MediaPost publication reports a unique court case between two law firms over the potentially illegal use of competing brand names. A firm accused competitor of violating Wisconsin’s privacy law by using their names in promotional efforts. However, the court published an 18-page ruling that concluded the practice doesn’t violate state law.
